Page No.# 2/3 Section 438 of the Bharatiya Nagarik Suraksha Sanhita, 2023 against the order dated 01.09.2025 in NCB Crime No. 3/2025 (NDPS Case No. 81/2025) passed by the learned Sessions/Special Judge, NDPS, Cachar, Silchar. 2. Heard learned counsel Ms. M. Deka on behalf of learned Standing Counsel Mr. S.C. Keyal for the NCB, who has raised objection and an affidavit-in- opposition has also been filed against the petition, denying the declared insured value of the vehicle as conclusive or decisive. It is submitted that the vehicle was involved in a heinous offence of transporting 7.473 kgs of Methamphetamine tablets. 3. The petitioner has submitted that the declared insured value of the vehicle is Rs.6,06,893/- (Rupees Six Lacs Six Thousand Eight Hundred and Ninety Three) whereas the condition for bail is an enormous amount of Rs.15,00,000/- (Rupees Fifteen Lacs) as bank guarantee. The petitioner has prayed to set aside the order imposing the bank guarantee of Rs.15,00,000/- (Rupees Fifteen Lacs) to be furnished as security by the petitioner. 4. It is submitted that Annexure-1 of the petition clearly reveals that the age of the vehicle is 9 years and 11 months. It is further submitted that Annexure-5 of the petition clearly reveals the declared value of the vehicle is Rs.6,06,893/- (Rupees Six Lacs Six Thousand Eight Hundred and Ninety Three)
5. I have considered the submissions at the bar with circumspection. 6. In view of the foregoing discussions, this Court deems it appropriate to reduce the amount of bank guarantee of Rs.15,00,000/- (Rupees Fifteen Lacs) to Rs.6,00,000/- (Rupees Six Lacs).

Page No.# 3/3 01.09.2025 in NCB Crime No. 3/2025 (NDPS Case No. 81/2025) passed by the learned Sessions/Special Judge, Silchar, Cachar, directing the IO to release the vehicle in zimma to the registered owner after examining the original documents is modified and the bank guarantee is reduced from Rs.15,00,000/-/ (Rupees Fifteen Lacs) to Rs.6,00,000/- (Rupees Six Lacs). 7.
