The tenant Sh. Brij Mohan Sharma is present in the Court today. Sh. Prem Prakash Dehloo, the landlord is also present in person. 2. The tenant Sh. Brij Mohan Sharma has filed an undertaking in the Court with the promise to vacate the premises i.e. Basement Floor of Dehloo Niketan near Gurudwara, Old Bus Stand, Shimla,

Sh. Prem Prakash Dehloo, the landlord has agreed that he will not execute the order of eviction till 31.03.2026, passed against the petitioner/tenant in case he complies with the undertaking so given by him to the Court today. 4. In terms of undertaking furnished by the tenant/petitioner before this Court today, he has agreed to suffer the eviction order as passed by learned Rent Controller, Court No. 1, Shimla, on 14.03.2024 in Rent Petition No. 80-2 of 2021 and affirmed by learned Appellate Authority (CBI Court) Shimla, H.P. vide judgment dated 11.07.2024, passed in Appeal No. 4-S/13B of 2024 on the assurance of the landlord that the order of eviction shall not be executed till 31.03.2026. 5. Accordingly, in terms of the understanding between the parties, their separate statements have been recorded in the Court today. The undertaking furnished by the petitioner is accepted and petitioner
3 Neutral Citation No. ( 2025:HHC:14456 ) has been made aware about the consequences of non-compliance of the undertaking. 6. The instant petition, is accordingly, dismissed. However, with the condition that the respondent/landlord will not execute the eviction order against petitioner till 31.03.2026. The petitioner shall vacate and handover the peaceful possession of the above noted premises to the landlord on or before 31.03.2026, failing which the order shall become immediately executable and in addition to execution of the order against the tenant, he shall also be liable for consequences under the Contempt of Courts Act. 7.
The petition is, accordingly, disposed of, so also the pending miscellaneous application, if any. (Satyen Vaidya) 19th May, 2025
