GP FOR HOME The Court made the following: 2 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus by declaring action of the respondents in not investigating into the case by recovering the amount of Rs.4,20,819/- from the accused in Crime No.78 of 2018 of Bommanahal Police Station, Ananthapur District, as illegal, arbitrary, irregular, irrational, without jurisdiction and in violation of natural justice and offends Articles 14, 21 and 300-A of Constitution of India and consequently direct the respondents to investigate into the case by recovering the amount of Rs.4,20,819/- in Crime No.78 of 2018 of Bommanahal Police Station, Ananthapur District and investigate in Crime No.78 of 2018 within stipulated time fixed by the Hon’ble court and other necessary order passed against the respondents.” 2. Sri J.Sunil Kumar, learned counsel for the Petitioner would submit that, a direction may be given to the Police to conclude the investigation and file charge sheet in Crime No.78 of 2018 on the file of Bommanahal Police Station, Anantapur District. 3. Sri V.Farooq, learned Assistant Government Pleader for Home would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of directing the Police to conclude the investigation, if not concluded, in the above crime and file a report in accordance with law, within a period of two months from the date of receipt of copy of this order. There shall be no order as to costs.
