1. Both the writ petitions are taken up for hearing together since the parties are common and the issues raised are pertaining to the same subject land. 2. The petitioner herein claims to be in possession of a parcel of land admeasuring 0-44-50 H-A-Sq.mts. at Adalaj, Gandhinagar. It is the case of the petitioner that the land in question has been granted / allotted to the respondent No.6 Trust by order dated 08.08.2023 passed by the District Collector, Gandhinagar. The case of the petitioner is that the said land was granted to the father of the petitioner for cultivation on one year basis. Thereafter, his late father was cultivating the same and then the petitioner is also cultivating. Upon coming to know about the allotment, the petitioner has also made application dated 31.08.2023 for allotting the same land. 3. Upon instructions, learned advocate for the petitioner
C/SCA/9629/2025 ORDER DATED: 05/08/2025 submits that since the land in question has been allotted to the respondent No.6 Trust, the petitioner will make an application for allotment of another parcel of land for his cultivation to the Collector. He submits that the same may be decided expeditiously. He also submits that the petitioner will not press the application dated 31.08.2023 for grant of land being Survey No.400/22 (new Survey No.518/1) at village Adalat, Gandhinagar, which is allotted to the respondent No.6 Trust. 4. Mr. D.K.Puj, learned advocate for the respondent No.6 Trust submits that he has no objection if the petitioner makes a fresh application for allotment of any other parcel of land. 5. Considering the submissions, if the petitioner makes a fresh application for grant of land to the District Collector, Gandhinagar, the same shall be decided expeditiously on its own merits and in accordance with law and the prevalent Government Resolutions within a period of 10 weeks from the date of receipt of such application. 6. It is made clear that this Court has not gone into the merits of the case nor any opinion is expressed thereon. The Special Civil Application No.9629 of 2025 is accordingly disposed of in aforesaid terms. In view of disposal of Special Civil Application No.9629 of 2025, the Special Civil Application No.9630 of 2025 is not pressed by the learned advocate for the petitioner.
