The petitioner has preferred the present writ petition with the prayer following prayer: "(i) A writ, order or direction in the nature of mandamus commanding the Collector/District Magistrate Rampur should be directed that he or his subordinate officer or nominated employee should not evict the petitioner from the Southern part of his Gata No. 196 and until the demarcation of the Gata Nos. 196/194. 193 and 192 is done, the Garbage house should not be constructed by including the land of Gata No. 196 on Gata No. 195." 2. It is argued that wholly illegally Respondents are trying to uproot trees and standing wheat crops lying on the aforesaid land without any demarcation. On the other hand it is argued by the learned Standing Counsel appearing on behalf of the State as well as Sri Arun Kumar Pandey learned counsel appearing on behalf of Respondent No.3 that in case the petitioner is aggrieved against the aforesaid acts on the part of the respondents before approaching this Court, the petitioner should first of all make his complaint before the authorities. 3. At this point of time a prayer has been made by the counsel for the petitioner to dismiss the present writ petition with liberty to approach the authorities. 4. The instant petition is dismissed as prayed. 5. It is made clear that petitioner will submit a representation ventilating his grievances before the concerned competent authority who take in the matter expeditiously.
