JUSTICE KARDAK ETE ORDER Date : 28.11.2025 Heard Mr. M. Dutta, learned counsel for the applicants/writ petitioners. Also heard Mr. S. Dutta, learned Standing Counsel, P&RD for the respondents and Mr. N. Goswami, learned Government Advocate for the State respondents. 2. This is an application seeking suspension of the order/notice dated 01.11.2025, issued by the Secretary, Algapur, Mohanpur, Gaon Panchayat, whereby, the petitioners have been directed to deposit the remaining 70% of the kist money/bid value. 3. The petitioners have filed the connected writ petition being aggrieved by the non-allotment of shops for which they had participated in the tender process and were declared successful bidders on an individual basis. Subsequently, the respondent authorities handed over possession of the respective shops to them pursuant to the tender process. The petitioners have deposited 30% of the bid value and the remaining 70% is due to be deposited in terms of the lease agreement. 4. Mr. M. Dutta, learned counsel for the applicants, fairly submits that the petitioners are ready to deposit the remaining balance of the kist money/bid value. However, as some persons have filed writ petitions Page No.# 9/10 claiming rights over the same shops, the petitioners apprehend that, in the event ownership is granted in favour of those persons, they would be prejudiced. 5. On the other hand, Mr. S. Dutta, learned Standing Counsel, P&RD submits that since the petitioners have been given the possession of the shops and in terms of the tender, the petitioners have only deposited 30% of the kist money/bid value and the 70% are to be deposited, the petitioners have been directed to deposit the balance amount. Therefore, there is no illegality in directing the petitioners to deposit the remaining 70% of the kist money/bid value. 6. It is noticed that this Court in the connected writ petition by an order dated 15.10.2025 has directed to maintain status quo as on that day, however, by subsquent order dated 23.10.2025, has clarified that the status quo order passed on 15.10.2025 was with regard to de facto possession by the parties and it was not intended to restrain the authorities from demanding or taking into deposit the 70% of the tender amount from the petitioners, who are in possession of the shops. 7. Having considered that there would be no bar to demand the deposit of 70% of the bid value, as clarified by this Court on 23.10.2025 and considering that the petitioners are in possession of the shops pursuant to the order and are thereby obligated to deposit the remaining 70% of the kist money/bid value, this Court is not inclined to interfere with the demand of the respondents for depositing the remaining 70% of the kist money/bid value from the petitioners. 8. Accordingly, although the deposit was originally required to be Page No.# 10/10 made within 15 (fifteen) days from the receipt of the order dated 01.11.2025, the applicants/writ petitioners are directed to deposit 70% of the kist money/bid value within 10 (ten) days from today. Such deposit shall, however, be subject to the outcome of the writ petition. 9. The interlocutory application stands disposed of. JUDGE Comparing Assistant
