Neutral Citation No. - 2025:AHC:55466-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 536 of 2025 Petitioner :- Jai Bahadur Singh Respondent :- State of U.P. and 6 others Counsel for Petitioner :- Tara Chand Kaushal Counsel for Respondent :- Rajiv Singh, S.C., Rameshwar Prasad Shukla Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J. 1. This petition purportedly in public interest has been filed by the petitioner seeking to question the action of the respondents in constructing the Annapurna Bhawan/ fair price shop at the location pursuant to the resolution passed by the Land Management Committee of the Gram Sabha dated 27.11.2023. 2. The allegations made in the representation pertains to the access to the proposed location where the shop is being constructed indicating that the access of heavy vehicles to the said location is not possible and, therefore, the land which has been selected is not appropriate. Based on the same, challenge has been laid to the construction of the fair price shop. 3. Instructions have been produced by the respondents, inter alia, indicating that the allegations made with regard to the location are factually incorrect. Already major part of the construction of the fair price shop is already over and picture of the location is being placed on record, which clearly reflects that the same is easily accessible from the main road, rather the shop in question has been constructed on the road. 4. Having gone through the instructions produced by the respondents along with the picture, the instructions are taken on record, we do not find any substance in the petition filed by the petitioner and the same is, therefore, dismissed.
