Heard Mr. S.K. Poddar, learned counsel for the petitioner. Also heard Mr. M.P. Goswami, learned Additional Public Prosecutor for the State respondent and Ms. K. Taye, learned counsel for the respondent no.2/informant. 2. By invoking the provisions of Section 483 of the BNSS, 2023 the accused petitioner Sri Priyo Ranjan Singha @ Sankar Sarkar is seeking regular bail in connection with Bongaigaon P.S. Case No.231/2025 registered under Sections 65(1)/89 of the BNS, 2023 read with Section 6 of the POCSO Act, 2012
3. The accused is in custody since 05.09.2025. The case has been charge-sheeted upon completion of investigation. Scanned case record is available, from which I have perused the statement of the victim girl recorded under 183 BNSS. From the statement, it reveals that though she was a minor, it started as a consensual relationship but subsequently, there are some adverse materials in the statement against the petitioner. Accused is stated to be aged 21 years and working in the Railways. 4. Mr. M.P. Goswami, learned Addl. P.P. has opposing the bail and submits that the trial should progress and the bail may be considered after examination of the victim. 5. The petitioner side has submitted one agreement between the mother of the girl and the mother of the boy about settling the issue in the context of their relationship. 6. Ms. K. Taye, learned counsel for the informant submits that the boy and the girl are still in a relationship and they are proposing to get married and she also supports
Page No.# 3/3 the agreement. The learned counsel for the informant submits that the informant has no objection to grant of bail. 7.
Accordingly, in the given facts and circumstances, the accused person herein is allowed to go on bail of Rs. 30,000/- with one surety of like amount to the satisfaction of the learned Special Judge, Bongaigaon and subject to the following conditions that:- (i) That the accused person shall co-operate with the remaining investigation. (ii) That the accused shall not hamper or tamper with evidence. (iii) That the accused person shall not in any manner intimidate harass or harm the informant and his family members. 8. In case of violation of any bail conditions, it will be liable to be cancelled. 9. This bail application stands allowed and disposed of. 10. Send back the case diary. JUDGE Comparing Assistant
