ORDER 18.11.2025 (S.K. Medhi, J) Heard Shri K. Mira, learned counsel for the petitioner, who has submitted that in spite of his best efforts, no communication could be made with the client and he accordingly submits that he would not like to appear.
2. This Court has noticed that this writ petition is pending since the year 2018 and even in the last occasion i.e. 17.11.2025 there was no representation on behalf of the petitioner and the following order was passed:
“None appears for the petitioner on call whereas the respondents are represented. Notice was issued in this case on 26.02.2018 along with an interim order. However, the matter was adjourned on behalf of the petitioner on the next date which was on 11.04.2023 i.e. after a lapse of about 5 years. On the next date, i.e. 31.07.2023, there was no representation from the petitioner and on 29.11.2023, again adjournment was sought for by the learned counsel for the petitioner. There was further no representation on 22.10.2025 and on the last
Page No.# 3/3 date i.e. 31.10.2025, this Court after adjourning the matter on the prayer of the
learned counsel for the petitioner had also remarked that this is an old pending matter. Be that as it may, let another chance be given to the petitioner and the matter be listed for consideration tomorrow i.e. 18.11.2025. It is made clear that in case of further non-representation, this Court would pass appropriate order(s).”
3. Also heard Mr. R. K. D. Choudhury, learned Deputy SGI; Mr. J Payeng, learned Standing Counsel, NRC and Home Department; Mr. M. Islam (on behalf of Mr. A. I. Ali), and Mr. P. Sarma, learned Additional Senior Government Advocate, Assam.
4. Considering the facts and circumstances, it is obvious that the petitioner is not interested to pursue this case and accordingly, the same is dismissed for want of non-prosecution.
