The subject Gokulam was already constructed and completed. After completion, the petitioner submitted a representation claiming subsidy to be granted by respondent Nos.3 and 4, who are the nodal agencies for granting such subsidy. While so, to the surprise of the petitioner, the 3^^ respondent herein issued an endorsement dated 01.03.2025 stating that the construction of said Gokulam by the petitioner was in survey No.90-4, which fails within the Government land. As such, the petitioner is not entitled for any subsidy as claimed by him. 2. Heard learned counsel for the petitioner and learned Government Pleader for Panchayat Raj and Rural Development representing respondent Nos.1 and 2 and learned Standing Counsel for ZPPS, MPPS & Gram Panchayats representing respondent Nos.3 and 4. Learned counsel for the petitioner submits that the petitioner is the 3. owner and possessor of the land in Sy.No.93 of Kagitalapur Village and the land in Sy.No.90-4 is the Government land. The construction of said Gokulam is within the land of the petitioner i.e., in Sy.No.93 of Kagitalapur Village. However, -without conducting proper survey, as contemplated 4 NV, J W.P.No. 18703 of 2025 t a under the Andhra Pradesh Survey and Boundaries Act, 1923 (for short ‘Act, 1923), the respondents unilaterally came to a conclusion and stated that the subject construction is within the Government land, for which, the petitioner submitted a representation requesting to conduct a survey by following due procedure after providing an opportunity of hearing to the petitioner as per the provisions of the Andhra Pradesh Survey and Boundaries Act, 1923. Learned Government Pleader for respondent Nos.1 and 2 and learned Standing Counsel for respondent Nos.3 and 4, categorically stated that if the petitioner submits an online application for conducting survey, the respondents will conduct survey afresh by following due procedure as contemplated under the Act, 1923. 4. Considering the submissions of both the learned counsel, this Court is of the opinion that the present writ petition can be disposed of directing the petitioner to submit an online application/F-Line application requesting for conducting survey in respect of the subject land in which the said Gokulam was constructed by the petitioner, within a period of two (02) weeks, from the date of receipt of a copy of this order. After such representation, respondent Nos.3 and 4, with the assistance of Mandal Surveyor, shall conduct the survey by following due procedure under the Act, 1923, within a period of two (02) months and provide survey report to the petitioner. 5. 5 NV, J W.P.
