1. Heard Mr. A.V Singh, learned counsel for the petitioner. Also heard Mr. K.K Das, learned Additional Public Prosecutor for the State of Assam.
2. By this application under Section 528/438 of the BNSS, 2023 R/W
Page No.# 2/3 Section 227 of the Constitution of India, the petitioner has challenged the various orders by which NBWAs were issued against the petitioner.
3. It is noticed that on 18.07.2019, the first NBWA was issued against the present petitioner and thereafter, on 13.08.2019, NBWA as well as proclamation was issued against the petitioner along with others and on subsequent dates too, fresh NBWAs were issued. Thereafter, vide order dated 06.01.2021, the petitioner was declared as a proclaimed absconder and consequently, the case was split up and the trial was initiated against other accused persons.
4. However, the learned counsel for the petitioner submits that the petitioner may be given an opportunity to appear before the Ld. Trial Court.
5. On the other hand, Mr. K.K Das, learned Additional Public Prosecutor for the State of Assam states that the petitioner was named as an absconder in the charge-sheet and was declared, as such, by the Court below and there is no illegality in the same and that the offence against which the petitioner was charged was also very serious.
6. In terms of the above observations, this Court deems it fit that the petitioner may appear before the Ld. Trial Court within 7(seven) days from the date of this order without fail and if he does not appear within the said days, necessary action will follow.
7. Thereafter, the petitioner may appear before the Court on every subsequent dates.
