Heard Sri V.Surya Kiran Kumar, learned counsel for the petitioners, learned Assistant Government Pleader for Endowments appearing for respondent Nos.1 and 2 and Smt. Pulipati Radhika, learned Standing Counsel for respondent No.3.

The present writ petition is filed challenging the auction notification dated 16.06.2025 issued by the 3rd respondent for conducting the auction of lease hold rights of agricultural land over an extent of Ac.4.50 cents situated in Sy.No.432/1&2 and 433/1&2 of Mallavolu Village, Guduru Mandal, Krishna District.

3. Smt. Pulipati Radhika, the learned Standing Counsel for respondent No.3, submits that pursuant to the auction notice, the petitioners have participated in the auction and they are declared as the highest bidders. Consequently, it has been proposed to grant in favour of the petitioners. The learned counsel submits that on 21.07.2025, this Court directed the respondents to proceed with the auction; however, directed the respondents not to finalize the lease till the next date of hearing. Therefore, in compliance thereof, the lease in favour of the petitioner(s) has not yet been finalized.
4. In view of the submissions made, and considering the fact that the petitioners are the highest bidders, the 3rd respondent-Temple is directed to grant the lease in favour of the petitioners at the rate bid by them at the auction. Petitioner seeks liberty to approach the Commissioner under Section 82 of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987, seeking recognition that the petitioners are landless poor person(s). The liberty as sought by the petitioner(s) is granted to approach the department seeking recognition as land less poor person.
5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
