GP FOR HOME 3 The Court made the following ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…..to issue any writ or order or direction more particularly one in the nature of WRIT OF Mandamus declaring the action of the respondent No.6 to summon the petitioner to the police station under the guise of investigation and pressurise him to settle the matter in terms of FIR No36/2025 dated 22/01/2025 for alleged offences under 417,420,506 IPC of the file of Ongole Taluk police station, Prakasam District as illegal and arbitrary consequently direct the respondents not call the petitioner to the 6TH respondent police station and pass……” 2. Heard Sri Rajareddy Koneti, learned counsel for the petitioner and Sri Md. Farook, learned Assistant Government Pleader. 3. Learned counsel for the petitioner would submit that a case has been registered in Crime No.36 of 2025 against the petitioner, wherein the petitioner was called to the police station by issuing a 41(A) notice. The petitioner appeared and furnished two sureties. Even thereafter, under the guise of investigation, the police are frequently calling the petitioner to the police station, threatening him to settle the matter relating to the above-mentioned crime. Learned counsel would further submit that the said case has been registered against the petitioner for offences under Section 420 IPC relating to a dispute with the unofficial respondent regarding the lease transaction. 4. Learned Assistant Government Pleader, on written instructions, would submit that the investigation in Crime No.36 of 2025 is under progress. On 16.07.2025, a notice was issued to the accused. Thereafter, they have never 4 summoned the petitioner to the police station under the guise of investigation to pressurize him to settle the matter with the unofficial respondents. Learned Assistant Government Pleader would submit that the petition may be disposed of. 5. Considering the submissions made, this writ petition is disposed of. However, the police are directed not to call the petitioner to the police station without any reason. The police are further directed to follow the procedure established by law.
