Ms. Anamika Pandey … for the Enforcement Directorate Re The petitioner being aggrieved by the fact that his movements were restricted because of the information furnished by the Directorate of Enforcement, he had to prefer this writ petition with number of prayers. Additionally, it has been contended that he appeared before the investigating agency and was available as and when called for. Be that as it may, a report has been submitted on behalf of the E.D. The report depicts that LOC has been issued against the present petitioner which is active and, till date, the investigation is in progress. However, no prosecution complaint has been filed. Learned advocate for the Union of India is also present. Having considered the report so submitted, the petitioner is granted liberty to challenge if the current status of the LOC is not commensurate with the conduct of the petitioner. So far as the prayers which have been advanced in the writ petition, the same is of the year 2022 and, substantial time has lapsed in the meantime. As such, the petitioner, if so advised, would address his grievances, if any, before the competent forum. However, so far as the restriction is concerned which is allegedly been imposed as has been contended by the petitioner, this court has not entered into the merits of the same and it would be for the appropriate forum to decide the same on merits in accordance with law. With the aforesaid observations, WPA 11435 of 2022 is disposed of. Pending application(s), if any, is also disposed of. Report so submitted be kept with the record. A copy of the report be handed over to the petitioner. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
