The petitioner has been made accused in connection with Special POCSO Case No. 36/2022 arising out of Bhandra P.S. Case No. 14/2022, for the offences registered under Sections 363, 365 & 366(A) of the I.P.C., subsequently Section 376 of the I.P.C. and Section 4 & 6 of the POCSO Act was added, pending in the Court of learned A.S.J.-I- cum-Special Judge, POCSO, Lohardaga. 3. On 03.03.2022, 15 years old daughter of the informant was kidnapped by the petitioner. She was forcibly taken to a brick kiln in West Bengal. The petitioner threatened not to disclose her kidnaping to anyone and continually raped her. 4. Learned counsel appearing on behalf of the petitioner submitted that the victim had herself gone with the petitioner as he was having love-affairs. 5. The age of the victim is opined to be between 15-16 years. The consent of the victim is immaterial. 6. Considering the nature of allegation, I am not inclined to release the petitioner, on bail.
