1. Heard Mr. H.R.A. Choudhury, learned Senior counsel assisted by Mr. S.S. Ahmed, learned counsel for the petitioners and also heard Mr. R. J. Baruah, learned Addl. P.P for the State. 2. This is an application under Section 482 of BNSS, 2023, have been filed by the petitioners, namely, 1. Abdul Sadik, 2. Abdul Basit, 3. Tabarak Ali @ Raim Uddin, seeking pre-arrest bail in connection with Ratabari P.S Case No.160/2025 under Section 126(2)/296/109/117(2)/303/351(2)/3(5) of the BNS, 2023. 3. The case diary along with injury report is available. 4. The allegation against the petitioners is that the informant of the case one Surajit Sinha lodged an FIR before the Officer In-Charge, Ratabari police station alleging inter alia that on 23.09.2025 while he was at Ratabari, Kazirbazar for puja shopping, the accused persons having pre-enmity, came there with dao/iron rod and confined him in the middle of market and started abusing him, and when he opposed, the accused nos. 2 and 3 held his hands and the accused no 1 hit his head with an iron rod as a result he suffered head injury, it was also alleged that the accused assaulted him and injured him seriously, also allegedly the accused persons snatched Rs. 15,530/-from his pocket and threatened to kill him on finding him alone. 5. A perusal of the injury report however, reveals only simple injuries caused by blunt objects. Page No.# 3/3
6. Having regard to the above, the custodial integration of the petitioners may not be necessary. 7. Accordingly, the prayer for pre-arrest bail is allowed. 8.
It is directed that in the event of arrest in connection with this case, the accused-petitioners, named above, shall be released in connection with Ratabari P.S Case No.160/2025 under 126(2)/296/109/117(2)/303/351(2) of the BNS, 2023, on furnishing bail bond of Rs.50,000/-(Rupees Fifty Thousand) each with two suitable surety each of like amount to the satisfaction of the arresting authority. 9. The direction for bail is further subject to the conditions: (a) They shall co-operate with the investigation and appear before the I.O as and when called for. (b) They shall not hamper or tamper with evidence; and (c) They shall not try to influence or intimidate the witnesses in any manner. 10.
