The instant Cr.M.P. has been filed with a prayer for restoration of A.B.A. No. 6897 of 2023 to its original file which was dismissed for default on 03.05.2024 for non-compliance of order dated 19.04.2024 passed by this Court. 3. Learned counsel for the petitioner submitted that due to ailing health of the conducting lawyer, the defects could not be removed on time and there was apparent delay in removal of defect and when the defect was removed on 03.05.2024, the stipulated time had already elapsed and hence the order dated 19.04.2024 passed in A.B.A. No. 6897 of 2023 passed by this Court could not be complied and the same became infructuous. It is further submitted that it is the bona fide mistake of the petitioners and there is no intentional delay in filing the restoration petition. 4. Learned Addl. P.P. appearing for the State has filed counter- affidavit which is taken on record but no serious objection has been raised for restoration of A.B.A. No. 6897 of 2023. 5. Considering the aforesaid submission of the learned counsel for 2025:JHHC:13209 2 Cr.M.P. 303 of 2025 the petitioners and for the ends of justice, A.B.A. No. 6897 of 2023 is restored to its original file. 6.
