THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 24460 of 2020 ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus to declaring the action on the part of the respondents herein not yet filed the charge sheet in FIR No. 255/2019 dated 08.11.2019 under sections 376(1),417,420,493 r/w 109 IPC even though the investigation was completed long back as illegal arbitrary and contrary to the provisions of the Cr.P.C and also articles of the provisions of Constitution of India and consequentially direct the respondents to file the charge sheet forthwith in the FIR No. 255/2019 and pass.…”
2. When the matter was taken up for hearing, learned counsel for the petitioner would submit that the petition may be disposed of, since the relief has become infructuous in this matter.
3. Learned Assistant Government Pleader for Home for the respondents is in attendance.
4. Recording the above said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
