Learned Amicus Curiae appearing for the appellant has submitted that the appellant was sentenced to undergo R.I. for 3 years which he has sustained and was released from the judicial custody. Learned Amicus Curiae appearing for the appellant has further submitted that he does not want to proceed with this appeal on merits. Therefore, this appeal may be dismissed. 2. Learned A.P.P. appearing for the State has not controverted the contentions raised on behalf of the appellant and has also produced an affidavit along with report showing that the appellant, Thakur Mahto has been released on 03.05.2005 even before the preferring this appeal. The affidavit produced before the court by the learned counsel for the State is taken on record. 3. Considering the above, this appeal is dismissed. 4. Pending I.A.’s, if any, is also disposed of accordingly. 5. Let a copy of this order along with Trial Court Records be sent back to the court concerned for information and needful. 6.
