1. Heard Mr. S. Munir, learned counsel for the petitioner. Also heard Mr. D.P. Goswami, learned Addl. Public Prosecutor for the State respondent. 2. This anticipatory bail application under Section 482 of the BNSS, 2023, has been filed by the petitioner, namely, Rabiul Haque Choudhury, seeking privilege of pre-arrest bail, apprehending arrest in connection with Boko P.S. Case No. 368/2025 under Sections 318(4)/ 316(4)/ 3(5) of the BNS, 2023. 3. The learned counsel for the petitioner has submitted that as per the F.I.R., some manipulation has been alleged in the weight of the raw-materials utilized
Page No.# 2/2 by the industry as against the weight of the finished products led out of the company. The learned counsel for the petitioner has submitted that the petitioner is the owner of one of the trucks which was used by the company for transportation requirements of the company. The learned counsel for the petitioner has submitted that the petitioner is not involved in any internal affairs of the company or during the weight of any of the materials. Despite that he is apprehending of arrest since his truck is used by the company for transportation. 4. The learned Addl. Public Prosecutor has submitted that no such facts are apparent in the present case, but participation of the petitioner in the investigation may be required during the investigation of the case. 5. In view of the above, this court is of the view that the petitioner shall appear before the I.O. of Boko P.S. Case No. 368/2025 within a period of seven days from today for investigation and to have his statement recorded. 6. It is provided that in the event of arrest of the petitioner in connection with Boko P.S. Case No. 368/2025, the petitioner shall be released on bail on furnishing a bond of Rs. 10,000/ (Rupees ten thousand only) with one surety of the like amount to the satisfaction of the arresting authority. 7.
It is further provided that the petitioner shall cooperate with the investigation as and when required and shall not hamper or temper with any evidence of the case. 8. The bail application stands disposed of. JUDGE Comparing Assistant
