PUBLIC PROSECUTOR The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 7689/2025 ORDER: The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of BNSS., has been filed by the Petitioners/Accused Nos.1 & 2, seeking quashment of the proceedings pending against him in C.C.No.293 of 2021 on the file of Judicial First Class Magistrate at Ponduru, for the offences punishable under Section 32 of the Drugs and Cosmetics Act, 1940 and Rules madeo there under for Contravention of Section 18(a)(i) r/w Section 16 of the Act. 2. Heard Sri I.Bala Subrahmanyam, learned counsel for the Petitioners/Accused Nos.1 & 2 and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. 3. Learned counsel for the petitioner would submit that the petition may be disposed of without causing any prejudice to the rights and contentions of the petitioners, by dispensing the presence of the petitioners/Accused Nos.1 & 2, before the Trial Court. 4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. 5. Considering the submissions made, the Criminal Petition is disposed of. However, the presence of the petitioners/Accused Nos.1 & 2 before the Trial Court is dispensed with unless their presence is specifically directed by the Trial Court. However, the petitioners are at liberty to raise all his contentions before the Trial Court in his defence.
