JUSTICE PRAMIL KUMAR MATHUR Order 12/05/2025 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.0522/2024 registered at Police Station-Jhotwara, District-Jaipur (West) for the offences under Sections 351(2), 137(2) of BNS. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and FIR has been registered with a delay of six days. There is no entry of the victim in the register of the Hotel and there is no CCTV footage. There is material contradictions between statement recorded during the investigation as well as statement of the victim before court. He further submits that the charge-sheet has not been filed under the (2 of 2) [CRLMB-237/2025] IT Act. This is the case of black mailing. The petitioner is behind the Bar since 15.08.2024. Charge-sheet has been filed and the trial of the case may take considerable time, hence the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor as well as counsel for the complainant have vehemently opposed the bail application. 5. Learned counsel for the complainant has submitted that the petitioner is in regular habit of committing the offence of black mailing. The victim, who is around the age group of 14 to 15 years at the time of incident, has corroborated the prosecution story during the investigation as well as the court statement. He further submits that as per the analysis report of the Mobile recovered from the petitioner, there are obscene photographs of the victim, therefore the petitioner may not be enlarged on bail. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, especially the statement recorded before the Court and obscene photographs of the victim in mobile but without expressing any opinion on the merits/demerits of the case, I am not inclined to grant benefit of bail to the petitioner. 6. Accordingly, the bail application under Section 483 B.N.S.S. is dismissed. (PRAMIL KUMAR MATHUR),J Sunita /14
