Page No.# 2/3 ORDER Date : 18-11-2025 Heard Mr. T. Laskar, learned counsel for the accused applicants. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State respondent. 2. This is an application filed under Section 482 of BNSS, 2023 praying for pre-arrest bail to the accused applicants in connection with Doboka P.S. Case No.180/2025, registered under Section 299/196 of BNS, 2023, read with Sections 5(1)/7/13 of Assam Cattle Preservation Act, 2021. 3. An FIR was lodged on 15.09.2025 by one S. I., namely, Anupam Borah before the Doboko police station alleging that on receipt of certain information at about 8:30 AM, about alleged involvement of the accused applicants running a slaughtering house at Bighalijaroni village and illegally selling and transporting beef meat, the police went to the said place and recovered 25 kgs of suspected beef meat. It was alleged that the aforesaid place falls within a radius of 5 km from Burigaon Kali Mandir and as per law, slaughtering is prohibited within a range of 5 km from any religious institution as per the provision of Assam Cattle Preservation Act,
2021. 4. Police has seized the aforementioned raw beef meat and accordingly, registered Doboka P.S. Case No.180/2025 under aforementioned sections. The learned counsel for the accused applicants submits that accused applicants have been falsely implicated in the instant case and no raw beef
Page No.# 3/3 meat has been recovered from their houses. He submits that raw meat was, in fact, found in the spot near to their residents and therefore, the police on suspicion has named them and alleged them to be a culprit of the offences mentioned in the FIR.
In view of the aforesaid, he further submits that the accused applicants shall cooperate with the investigation, in the event, this Court allows them to go on pre-arrest bail. 5. On the other hand, the learned Additional Public Prosecutor has submitted that there are sufficient materials against the accused applicants implicating them of involving on the offence so alleged in the FIR. Therefore, he submits that the instant bail application should not be allowed, at this stage. 6. This Court has gone through the case diary submitted before this Court and also heard the submissions forwarded by the respective counsel appearing for the parties. On the perusal of the case diary, it is, prima facie, seen that the alleged raw beef meat was seized from the house of the accused persons as well as there are materials available in the case diary which implicate prima facie involvement of the accused applicants in the offence so alleged in the FIR. 7. In view of the, prima facie, finding of this Court, the instant anticipatory bail application is disposed of as rejected. JUDGE Comparing Assistant
