ORDER
The case is taken up before the National Lok Adalat.
The appellant, National Insurance Company Limited, is represented by its duly authorized officials, namely, Mr. P. D. Bhutia, Regional Manager, and Mr. Debajit Sarkar, Assistant Manager.
Mr. L. R. Mazumder, learned counsel, appears on behalf of the claimants and is present along with claimant No. 1, namely, Suma Begum Barbhuiya.
It is submitted that the total awarded amount is Rs. 20,84,800/- (Rupees twenty lakhs eighty four and eight hundred) only. After negotiation, both the parties have mutually agreed to settle the matter for a sum of Rs. 19,00,000/- (Rupees nineteen lakhs), out of which Rs. 10,42,400/- (Rupees ten lakhs forty two thousand four hundred) only has already been paid and a balance amount of Rs. 8,57,600/- (Rupees eight lakhs fifty seven thousand six hundred) only is agreed upon as a full and final settlement of the claim.
Accordingly, the appellant/National Insurance Company Ltd. is hereby
directed to deposit the remaining balance amount of Rs. 8,57,600/- (Rupees eight lakhs fifty seven thousand six hundred) only before the Motor Accident
Page No.# 4/4 Claims Tribunal, Cachar, within 1 (one) month from the date of the order.
It is further noted that during the pendency of the present appeal, the claimant No. 4, Jali Bibi, mother of the deceased, has expired. Consequently, the said settled remaining amount of Rs. 8,57,600/- (Rupees eight lakhs fifty seven thousand six hundred) only shall be shared equally amongst the claimant Nos. 1, 2 & 3.
The respective shares of claimant No. 2, namely, Saniya Begum, and claimant No. 3, namely, Suniya Begum shall be deposited in their names as fixed deposits in any nationalized bank till they attain their majority.
The claimant, namely, Suma Begum Barbhuiya, is permitted to withdraw her share of the amount, which will be deposited by the Insurance Company before Motor Accident Claims Tribunal, Cachar, upon proper verification and identification.
Registry to refund the statutory deposit of Rs. 25,000/- (Rupees twenty five thousand) only to the appellant/Insurance Company.
The appeal stands disposed of in terms above. JUDGE Comparing Assistant
