Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He submits that second bail application preferred on behalf of the petitioner was dismissed by this court on merits and as such, there is no material change in circumstances warranting interference of this Court. 5. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced by learned counsel for the parties, especially considering the role attributed to the petitioner, as also the fact that weapon used in commission of crime has been recovered at the instance of the petitioner and further considering the ballistic expert report, this court is not inclined to enlarge the petitioner on bail. 6. Accordingly, this third bail application stands dismissed. 7. The observations made hereinabove are only for decision of the bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J MADAN/111
