ORDER: _\{.( The Criminal PetI|tiOn has been filed under Sections 480 and 483 of the BharatI|ya Nagarik Suraksha Sanhi{a, 2023 (for brevity tthe BNSSJ), seeking to enlarge the petI'tl'OnerS/Accused Nos.1 to 3 on bail in Cr.No.,83 of 2025 of Talla Proddatur Police Stall-on, Talla Proddatur, YSR Kadapa District, registered against the petitioners/Accused Nos.1 to 3 herein for the offences punishable under Sections 329(3), 324(4), 308(5) read wI'th SectI'On 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity lthe BNSJ). 2. As seen from the record the petitioners 1 {o 3/Accused Nos.1 to 3 demanded the de-facto complainant for an amount of Rs.2,000/-, but he refused to pay it, the petI'tiOnerS trespassed into the mOSambi Orchid Of the de-facto complainant and indiscriminately cut 41 mosambi trees and caused loss to the de-facto complainant and also threaten him with dire consequences. The petitioners were arrested on o7.06.2025 and ever since they have been in J-udiCial Custody. 3. The learned Assistant Public Prosecutor submits that there are three eye witnesses namely LWs.2 to 4, who have witnessed the <=-=.=±

The learned Assistant Public Prosecutor, on perusal of the cD, submits that there are three adverse antecedents against the petitioner No.2/accused No.2, they are: (1) Cr.No.87 of 2021 under Section 302, 509, 212, 120(b) read wI|th 149 lPC and Section 25(1B)(b) of The Arms Act, 1959 of Yellanuru Police Station; (2) Cr,No.49 of 2024 under Section 9(1) of A.P.Gaming Act (GamblI'ng) and section 7-B read with 8-A, 8-B of A.P,ProhibI'tiOn Act of Talla Proddatur Police Station,I and (3) Crime No.99 of 2024 under Section 132 of fthe BNSj of Talla Proddatur Poll-Ce Statl|on. lt is also further submitted that there is one adverse antecedent against petI-tiOner No.3/accused No.3, i.e., Cr.No.87 of 2021 under Section 302, 509, 212, 120(b) read with 149 lPC & Section 251(B)(b) of the Arms Act,1959 of Yellanuru Police Station. 4. Considering the nature and gravity of the allegations levelled against the petitioner Nos.2 and 3, the request of petitioner Mos.2 and 3/accused Nos.2 and 3 is not reasonable at this juncture. Hence, the petition against them is dismissed. 5. However, as seen from the record, there are no adverse I antecedents against the petitioner No.1/accused No.1. I-i_=.`.-. 6.
Yet, the de-facto COmPlainant and accused No.1 did sheep rear`Ing business and with regard to that, there are certain disputes between the petitioner No.1/accused No.1 and the de-faCtO COmPIainant. 7. Considering the transaction in between the Petitioner No.1 and the de-facto complainant, no adverse antecedents reported aga'lnst him and the period of detention for the past 51 days, this Court is inclined to enlarge the petitioner No.1/accused No.1 on bail with the following stringent conditions. i. The petitioner No.1 shall be enlarged On bail subject to the executing a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand only), With two Sureties each for the like Sum each to the satisfaction of the learned Additional Judicial Magistrate of First Class, Jammalamadugu, YSR Kadapa District. ii. The petit'loner No.1 shall appear before the Station House Off'lcer, Talla Proddatur Police Station, Talla proddatur, ysR Kadapa D'lstrict, on every Saturday in between 10:00 am and 05:00 pm, till cogniZanCe iS taken by the learned the Trial Court. iii. The petitioner No.1 shall not leave the limits Of the District without Prior Permission from the learned Additional t- .I c`.-=_.
