The petitioner is apprehending his arrest in connection with Nawalshahi P.S. Case No.29 of 2025, registered for the offence under Sections 303(2), 132 of Bharatiya Nyaya Sanhita, 2023, Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017 and Rule 54 of the Jharkhand Minor Minerals Concession Rules, 2004, pending in the Court of the learned Judicial Magistrate, 1st Class, Koderma. 3. Learned counsel appearing for the petitioner submits that the petitioner is the owner cum driver of the truck and the allegations are made that 500 cft. stone boulder was loaded on the said truck. He further submits that the petitioner has got no criminal antecedent, which has been disclosed in paragraph 16 of this application. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of carrying 500 cft. stone boulder. 5. Considering that the petitioner is the owner cum driver of the truck and he has got no criminal antecedent and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest/surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Koderma in connection with Nawalshahi P.S.
