Dated : OCTOBER 14, 2025 PER COURT :- . Heard the learned Advocate for the Applicant, the learned APP for the State and the learned Advocate for the Respondent No.2 – Informant. Perused the papers on record. 2. Crime bearing No.0220/2025 came to be registered with Waluj Police Station, Dist. Chhatrapati Sambhajinagar for the offence punishable under Sections 74, 78, 351(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023 (for short, ‘BNS’) and Sections 8, 12 and 17 of the Protection of Children from Sexual Offences Act, 2012 (for short, ‘POCSO’) against the Applicant and Co-accused. 3. The case of the Prosecution, in brief, is that, the Informant’s Daughter aged 16 years, 10 months had joined the computer course. The relative of the owner of the said computer institute got friendly with 2025:BHC-AUG:29045 2 the Informant’s Daughter. There was exchange of phone numbers. The said relative of the computer institute owner (Accused No.1) used to send massages to the Informant’s Daughter. On 19.07.2025 the said Accused No.1 caught hold the hands of the Informant’s Daughter and expressed his love towards her and asked her to accompany him or else, he will viral the video calls and the chatting massages and also threatened with dire consequences. Thereafter, on 21.07.2025 the Applicant, who is the Brother-in-law of the Accused No.1, made telephone call to the Informant and asked her to let the Accused No.1 marry with her Daughter or else, he will viral chats between the Accused No.1 and her Daughter. 4. The only role attributed to the Applicant is that, he threatened the Informant over the phone. Prima facie the sections of the POCSO and the offence punishable under Sections 74 and 78 of the BNS are not attracted against the Applicant. In this view of the matter, I am inclined to allow the Application. Hence, the following order. ORDER i) The Application is allowed. ii) In the event of arrest of the Applicant, namely, Nanasaheb Rajendra Salunke, in connection with Crime No.0220/2025 registered with Waluj Police Station, Dist. Chhatrapati Sambhajinagar, he be released on bail on executing P.B. of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. 3 iii) The Applicant shall attend the concerned Police Station from 17.10.2025 to 19.10.2025 between 10:00 a.m. to 02:00 p.m. and thereafter as and when called. iv) The Applicant shall not tamper the evidence of the Prosecution in any manner. v) The Applicant shall co-operate with the investigating machinery. vi) Bail before the Trial Court. vii) The Application stands disposed off.
