A perusal of the said order would indicate that the City Municipal Council (CMC), in fact, had granted permission for establishing a sawmill as per its No Objection Certificate (NOC) dated 25.03.2022, which reads as follows – “ಸಂTೆ:.ಎಂ./.ೆಎಂ/.ಆH/ಕಂDಾ/115/2021-22 ¢£ÁAPÀ: 25.03.2022 : +ಾ(ೇs^ಾ ಪತ : ಷಯ: +ಾ(ೇs^ಾ ಪತ ೋ1ರುವ ಬPೆt. ಉೇಖ: =ೕಮ ಪ"ಾ?ವ 7. ೋಂ ೇ ಆH.=ೕ+ಾo, ೇH ಆu ಜಯಪ!ರ 29ೇ ಾo, Jಕ:ಮಗಳLರು ಇವರ ಅ7- 89ಾಂಕ 19.03.2022 ****** ಈ _ೕಲ:ಂಡ ಷಯೆ: ಸಂಬಂ;.ದಂ<ೆ, Jಕ:ಮಗಳLರು ನಗರಸpಾ ಾಯರುವ ಾ*- ನಂ:13 ರ Tಾ<ೆ ಸಂTೆ: ಉ.Pಾ.ಸೆ- ನಂ.166 ರರುವ ರ - 5 - NC: 2025:KHC:1147 WP No. 12665 of 2023 ಅಳ<ೆ 612 ಚದರ ,ೕ. ಮತು ಉ.Pಾ.ಸ.ನಂ 166 ಅಳ<ೆ 630.50 ಚ ,ೕ ಇದುl ಸದ1 +ೇಶನಗಳ =ೕ Aಾಾ7 4ಾ,B <ೆೆಯಲು ಎw.ಒ.. ೋ1ದlರ _ೕೆPೆ ಸ[ಳ ಪ1=ೕ. ಮಹಜH ನ&ೆ.ದುl, ಈ ೆಳಕಂಡ ಷರPೆ ಒಳಪ`. ನಗರಸpೆbಂದ +ಾ(ೇsಣ ಪತ +ೕ`"ೆ. ಷರತುಗಳ ಷರತುಗಳ ಷರತುಗಳ ಷರತುಗಳ: 1) 4ಾ,B <ೆೆಯಲು ಸಂಬಂ;.ದ ಇಾTೆbಂದ ಕ&ಾyಯಾU ಅನುಮ ಪ&ೆಯತಕ:ದುl. 2) ಸದ1 ಪ"ೇಶದ ಅನ ಾ.ಗPೆ <ೊಂದೆ ಾಗದಂ<ೆ ಮತು ದೂರುಗಳ ಬರದಂ<ೆ 4ಾ,B ನ&ೆಸುವ!ದು. 3) ನಗರಸpೆbಂದ ಕ&ಾyಯಾU ಾ(ಾರ ಪರಾ+PೆಯನುV ಪ&ೆಯುವ!ದು.” 3. As could be seen from the above, the City Municipal Council had granted permission, subject to the three conditions and the first condition was that permission was required to be obtained from the concerned Department. 4. Learned counsel for the petitioners submits that, as a matter of fact, the Forest Department, which is the Authority empowered to grant a license to establish a sawmill has granted a license on 29.05.2023, which is valid upto 31.03.2028. - 6 - NC: 2025:KHC:1147 WP No. 12665 of 2023 5. He also submits that the Municipal Council had also granted a Trading License on 25.07.2022. He also highlights the fact that the Karnataka State Pollution Control Board had also granted consent for operation to enable the petitioner to operate the sawmill. He, therefore, contends that the petitioners are running a sawmill in a lawful manner and at the instance of the proposed respondents these proceedings have been initiated. 6. It is to be stated here that once the CMC had granted permission to establish a sawmill and the concerned Department, namely, the Forest Department had also granted a license to establish a sawmill, it would be improper on the part of the CMC to call upon the petitioners to stop the operation of the sawmill. Therefore, Annexure-G cannot be sustained and the same shall have to be quashed and it is, accordingly, quashed. - 7 - NC: 2025:KHC:1147 WP No. 12665 of 2023 7. However, learned counsel for the proposed respondents submits that running of the sawmill after 6 p.m. would cause noise pollution to the residents and appropriate orders be passed in that regard. 8. Learned counsel appearing for the petitioners submits that the petitioners would not run the sawmill after 6 p.m. 9. In the light of this statement, the apprehension of the proposed respondents shall also stand allayed. 10. The learned counsel for the petitioners concedes that the third prayer sought for directing respondent No.2 to grant power connection has already been complied with. 11. In view of the above, Writ Petition is allowed subject to, however, that the sawmill will not be run beyond 6 p.m. - 8 - NC: 2025:KHC:1147 WP No. 12665 of 2023 12.
