DEPUTY COMMISSIONER, UDUPI, UDUPI DISTRICT, UDUPI-576 104. …RESPONDENTS (BY SRI. MAHANTESH SHETTAR., AGA FOR R1, 4 & 2;
R3-SERVED AND UNREPRESENTED)
THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, SEEKING CERTAIN RELIEFS.
THIS WRIT PETITION IS LISTED FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, AN ORDER IS MADE AS UNDER:
ORAL ORDER Counsel for the petitioner and Sri.Mahantesh Shettar., AGA for respondents 1, 2 & 4 appeared in person.
2. Notice to the respondents was ordered on
22.06.2015. A perusal of the office note depicts that respondent No.3 is served and unrepresented. The third respondent has neither engaged the services of an advocate nor conducted the case as a party in person.
3. The Official Memorandum dated 14.05.2015 is called into question in this Writ Petition on several grounds as setout in the Memorandum of Writ Petition.

4. Counsel for the respective parties urged several
contentions. Heard the arguments and perused the Writ papers with care.
5. The Official Memorandum is furnished along with the Writ Petition and the same is marked as Annexure-F. It has been stated in the Official Memorandum that there is an interim
order passed by this Court on 06.10.2010 in W.P.No.31928/2010 and there was a violation of the interim
order. There was also a direction to strictly adhere to the interim order till the disposal of the Writ Petition. The E-Court status of W.P.No.31928/2010 reflects that the said Writ Petition was disposed of on 5th day of January 2018. Hence, I find no grounds to quash the Official Memorandum. In view of disposal of W.P.No.31928/2010, nothing survives for consideration in the present Writ Petition at this juncture.
6. Resultantly, the Writ Petition is disposed of.
