JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 3 13-05-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State assisted by learned counsel for the informant. 2. The petitioner seeks regular bail in connection with Hussainganj P.S. Case No. 03 of 2024 registered for the offence punishable under Sections-392 & 302 of the Indian Penal Code as well as 27 of the Arms Act. 3. Allegedly, in course of returning from his office, in the way, the deceased was intercepted and after looting his bike as well as bag containing the cash and other belongings, he was murdered. 4. Learned counsel for the petitioner has submitted that this is a case under Section 399 of the Indian Penal Code and a separate case for the same occurrence under Section 302 of the Patna High Court CR. MISC. No.17544 of 2025(3) dt.13-05-2025 2/2 Indian Penal Code has been lodged. It has also been submitted that nothing but only six puriyas of smack and cash Rs. 12,800/- was recovered. 5. On the otherhand, learned counsel for the informant and Mr. J.N. Thakur, learned Addl. P.P. have opposed the prayer for bail submitting that the deceased was working in Bharat Finance Inclusion Limited, Siwan branch on the post of Field Saraff. In course of returning from his office, in the way, the bike and bag containing cash belonging to the deceased were stolen away. 6. From perusal of the case diary, it appears that on the basis of disclosure made in their confessional statements by the co- accused Shailesh Kumar, the name of this petitioner has transpired. Later on, the house of the petitioner was searched and the stolen bag of the deceased containing papers of the finance company, in which, the deceased was working, was recovered. 7. Considering the aforesaid facts and circumstances, the petitioner does not deserve bail and accordingly, prayer for bail of the petitioner is rejected. A.K.V.//- (Nawneet Kumar Pandey, J) U T
