Sahay, A.P.P. ----- 02/26.09.2025 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Govindpur P.S. Case No.328 of 2024, registered for the offence under Sections 334 (2), 303(2), 317 (2) of the BNS, pending in the Court of the learned Judicial Magistrate, First Class, Dhanbad. 3. Learned counsel appearing for the petitioner submits that the petitioner has not been named in the FIR and his name has come on the basis of confessional statement. He further submits that the allegations are made that 01 battery of generator and eight batteries from the mixer truck have been stolen. He further submits that petitioner has criminal antecedent, but in that case, he has been granted bail. 4. Learned counsel appearing for the State opposed the prayer and submits that petitioner has criminal antecedent. 5. Considering that, the petitioner has criminal antecedent and the criminal antecedents cannot be only criteria for consideration of the anticipatory bail application or regular bail, however that cannot be one of criteria for consideration of anticipatory bail application or regular bail and in 2025:JHHC:30449 2 view of the nature of allegations in the present case, the petitioner has not been named in the FIR and the petitioner’s name has come on the confessional statement, in an earlier case, he has been granted bail and in facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Dhanbad in connection with Govindpur P.S. Case No.328 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated: 26th September, 2025 Simran/
