Applicant is in judicial custody in Sessions Trial No. 38 of 2024 in FIR No. 46 of 2024, under Section 376 IPC, Police Station Kaladhungi, District Nainital. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

Learned counsel for the applicant would submit that the co-accused Rakesh and Kumar have already been granted bail. The only role assigned to the applicant is that he got the victim married with the co-accused Kumar.

Learned State counsel would submit that the applicant’s case is that of parity with those co-accused, who have already been granted bail.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
