IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.6424 of 2024 ------ Sidharth Gupta, son of Jayanti Gupta, resident of Lohar Gali, Bangla School, PO Makatpur, PS Giridih, District Giridih, Jharkhand … … Petitioner(s) Versus The State of Jharkhand. … … Opposite Party(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Chandrajit Mukherjee, Advocate. For the State : Mr. Shiv Shankar Kumar, A.P.P. ----- 07/ 01.07.2025 Heard the parties. 2. This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 376, 504, 506 of the Indian Penal Code. 3. It is alleged that the petitioner has sexually exploited the victim on the pretext of marriage. 4. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 5. After hearing the parties, I find that both the petitioner and the victim are major. They entered into physical relationship though it is alleged on the pretext of marriage but later on the same did not materialized. Now as per the affidavit filed it is clear that they have also resolved their disputes. 6. Considering the aforesaid fact that the parties are major and they have resolved their dispute and the relationship developed because of their closeness, this Court finds it a fit case for grant of anticipatory bail to the petitioner. 7. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing
