02/ 22.09.2025: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Koderma P.S. Case No. 109 of 2025, registered under sections 303(2), 221, 351(2) of BNS, 2023 and Rule 13 of Jharkhand Minerals (Prevention of illegal Mining Transportation and Storage) Rules, 2017, Rule 4 and 54 of Jharkhand Miner Minerals Concession Rule, 2004, pending in the Court of learned Chief Judicial Magistrate, Koderma.

Learned counsel for the petitioner submits that initially F.I.R has been registered against the truck bearing Registration No. JH-12-D-2325 and after one month thereafter it has been stated that the said truck was not involved in carrying the stone chips and in place of that Truck bearing Registration No. JH-12-P-2325 was involved in carrying stone chips. He further submits that the petitioner happens to be owner of Truck bearing Registration No. JH-12-P-2325 and he has no criminal antecedent which is disclosed in para 15 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that illegally the stone chips was being carried in the said truck.

Considering that initially F.I.R has been registered against the

truck bearing Registration No. JH-12-D-2325 and after one month thereafter Registration Number of the Truck has been changed whose owner is petitioner and he has no criminal antecedent as disclosed in para 15 of the petition.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Koderma, in connection with Koderma P.S. Case No. 109 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
