GP FOR MUNCIPAL ADMN URBAN DEV The Court made the following: 3 ORDER:- Heard the learned counsel for the petitioners and Sri Yelisetti Somaraju, the learned Standing Counsel appearing for the 4th respondent. 2. The petitioners are aggrieved by the inaction on the part of respondent Nos. 2 to 8 in not issuing TDR bonds for the lands acquired in the year 2015. 3. It is submitted that the Special Officer for Godavari Pushkaram and the Commissioner of Municipal Corporation Rajamahendravaram have sought the issuance of a consent letter for surrendering an extent of 159.50 square yards (0.09 acres) of the plot against the promise to issue TDR bonds. The lands of the petitioners were acquired by the respondent corporation, and trading was also constructed. 4. It is submitted that, although the property was acquired in the year 2015, the TDR bonds were neither issued to the petitioner nor any compensation paid for the said land. 5. This Court directed the learned Standing Counsel appearing for the 4th respondent to get the latest instructions. Today, on receipt of written instructions, the learned Standing Counsel submits that further action will be initiated by the 4th respondent, subject to the petitioners executing the gift deed in favour of the 4th respondent. 6. It is further submitted that the respondents will take the necessary action in due course, after the mandatory process of road development plan 4 approval and upon the petitioners completing the gift registration at the earliest. 7. Considering the submissions, this writ petition can be disposed off at the admission stage by directing the 4th respondent to issue the TDR bonds for the lands parted by the petitioners in the year 2015. However, the petitioners are directed to execute the gift deed in favour of the 4th respondent for the lands parted in the year 2015. Upon execution of the said deed, the 4th respondent shall release the TDR bonds proportionate to the land parted by the petitioners within a period of six (06) weeks from the date of execution of the gift deed. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ___________________ JUSTICE HARINATH.N 28.07.2025 PNS 5
