Order on Board 12/06/2025
1. With the consent of the parties the present petition is heard finally. 2. The present petition has been filed by the petitioner praying for the following relief(s):
2
“10.1 That, this Hon’ble Court may kindly be pleased to call for the entire record pertaining to the case of the petitioner from the concerned authority. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondents to make correction in date of birth column of result card of the petitioner i.e. Annexure P/7 as
17.07.2001. 10.3 Any other relief may also be granted to the petitioner which this Hon’ble Court deems fit in facts and circumstances of the case.”
3. Brief facts of the case is that the petitioner was admitted in the Govt. primary school, Tifra and in Dakhil-Kharij Register of that school the date of birth of the petitioner was mentioned as
17.07.2002. On the basis of that Dakhil-Kharij Register, the petitioner moved an application before Gram Panchayat Gidhouri for his Birth Certificate and after verifying the same the Gram Panchayat issued birth certificate to the petitioner wherein the date of birth of the petitioner is mentioned as 17.07.2002. Thereafter the petitioner had taken admission in Class 5th at Govt. Pre Secondary School Tifra Bilaspur, C.G. On the marksheet of Class 5th also his date of birth is mentioned as 17.07.2002. Thereafter the petitioner moved to his village and completed rest
3 of his education in village Gidhouri. 4. Learned counsel for the petitioner contended that the correction in date of birth column of the result card issued by the respondents in the name of the petitioner is necessary to rule out further complications. In all the documents issued by the Govt. the date of birth of petitioner is mentioned as 17.07.2002 instead of 17.07.2001 which is evident from his Aadhar Card and PAN Card. He further prays to issue direction to the respondents to decide his application. 5. Learned counsel for the respondents submits that the application of the petitioner may be decided as per law and rules. 6. I have heard learned counsel for the respective parties and perused the record with utmost circumspection. 7.
Perusal of record shows that the date of birth of the petitioner has been mentioned as 17.07.2001 instead of 17.07.2002 in his report card of Class 10th which was conducted by C.G. Board of Secondary Education. In all the other documents such as Aadhar Card, PAN Card, etc, the date of birth of the petitioner is mentioned as 17.01.2002. The petitioner came to know about this mistake when he applied for Govt Jobs and during filling the forms he noticed that his date of birth is not correct in his academics result. He therefore, moved an application to the C.G. Secondary Education Board on 29.09.2023 stating therein that his date of birth has been wrongly mentioned as 17.01.2001 in his academic results but the oral direction was given by the respondents that
4 after 3 years, it is not possible for the Chhattisgarh Vyapam to correct the date of birth of the petitioner. 8. Therefore, looking to the facts and circumstances of this case, this Court directs the respondents to decide the application dated 29.09.2023 filed by the petitioner as per law and rules expeditiously within a period of 60 days from the date of receipt of copy of this order. 9. With the aforesaid direction, the present writ petition is hereby
disposed off. Sd/-
