Heard learned counsels for the parties.

The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 399/402 I.P.C. & Sections 25(1- b)a/26/35 Arms Act in connection with Kolebira P.S. Case No. 64/2022.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and no incriminating article has been recovered from the conscious possession of the petitioner. He further submits that the name of the petitioner has transpired only on the basis of confessional statement of the co-accused. He further submits that several co-accused persons have already been granted bail in B.A. Nos. 2718 of 2024, 12256 of 2023 and 5115 of 2023 and the petitioner for no offence has been languishing in custody since 20.12.2022; as such, the petitioner may be enlarged on bail. He submits that the petitioner is ready to abide by every condition as imposed by this court.

Learned A.P.P. opposes the prayer for bail of the petitioner.

Having regard to the facts of the case and looking to the allegation made against this petitioner coupled with the fact that several co-accused persons have been granted bail and the petitioner is in custody since 20.12.2022; therefore, I am inclined to enlarge this petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Simdega in connection with Kolebira P.S. Case No. 64/2022.

It is made clear that the petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall co- operate in trial and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
