Heard learned counsel for the parties. Petitioner before this Court is seeking reservation in the Physically Handicapped category and submits that there is a vacancy but the respondent Selection Commission has failed to select the petitioner by not providing him horizontal reservation. Per contra it has been argued on behalf of Commission that even though matter relating to answer key in relation to the examination in question is engaging attention of pending SLP No. 5828 of 2023, and Supreme Court vide para 3 has observed that any petition filed after 21.11.2023 any issue related to said examination shall not be entertained by any High Court. Learned counsel for the petitioner has sought to urge before the Court that SLP before the Court is engaging attention in respect of the examination pursuant to which the selection has been held whereas, the petitioner is seeking benefit of reservation. In my considered view, once the subject matter of examination is engaging attention of the Supreme Court and is sub judice then any petition arising out of said examination, may be after selection, should not be entertained as a matter of propriety. The Court is also of the considered view that if in any manner Supreme Court interferes with the answer key then the entire selection is liable to be adversely affected. However, liberty rests with the petitioner to seek appropriate relief in the pending Special Leave Petition before the Supreme Court, if so advised. In view of the above, I refuse to entertain this petition. Petition is accordingly dismissed.
