This writ petition has been filed for grant of following substantive reliefs:- “(i) That in view of the submissions made in the writ petition, the writ petition may kindly be allowed and the respondent department may kindly be directed to extend the benefit of regularization of petitioner on the completion of 08 years as per the award of Labour Court w.e.f. 01.01.2008. ii. That the respondent department may kindly be directed to count the period w.e.f. 01.01.2008 till his retirement for the purpose of pension.” 2. Respondents have filed the reply. In terms of the reply, case of the petitioner has been considered and vide 1 Whether reporters of Local Papers may be allowed to see the judgment? yes - 2 - office order dated 13.03.2025, passed by the respondents, petitioner’s services have been regularized on notional basis w.e.f. 01.01.2008 instead of 02.09.2015 by counting his daily wage working days w.e.f. year 2000. Reply also pleads that respondent No.3 vide office letter dated 05.04.2025 has submitted pension case of the petitioner alongwith requisite documents to the Senior Deputy Accountant General. Copy of orders dated 13.03.2025 and office letter dated 05.04.2025 are appended alongwith the reply. 3. In view of reply filed by the respondents, learned counsel for the petitioner submits that grievance of the petitioner has now been redressed, however, liberty be reserved to the petitioner to seek appropriate remedy at an appropriate stage, in accordance with law, in case his pension is not paid.
