2. Petitioner has been made accused in connection with S.T. Case No. 580 of 2023 arising out of Ghatshila P.S. Case No. 64 of 2023 corresponding to G.R. No. 183 of 2023 for the offences registered under sections of the Indian Penal Code / Bharatiya Nyaya Sanhita, 2023, pending in the court of learned District and Additional Sessions Judge-I, Ghatshila.
3. Bail application of the petitioner was earlier rejected by a Coordinate Bench of this Court vide B.A. No. 1120 of 2024 by order dated 21.06.2024.
4. On 27.07.2023 at about 6.30 p.m., Ghatshila police on the basis of confidential information that accused persons had assembled at a place near Bholenath Dhaba, raided the place of occurrence and apprehended several accused persons. Cache of arms and ammunition were recovered from their possession.
5. It was submitted that the petitioner was neither apprehended at the spot, nor anything was recovered from his possession. It was further submitted that the name of the petitioner has transpired in the confession of co-accused that they had assembled at the instance of the petitioner.
6. Ms. Ruby Pandey, learned A.P.P has opposed the prayer for bail and submitted that the petitioner is named in the FIR. On specific query, whether petitioner was apprehended at the spot, she submitted that the petitioner was not apprehended at the spot.
7. In view of the submission made above, petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned District and Additional Sessions Judge-I, Ghatshila in connection with S.T. Case No. 580 of 2023 arising out of Ghatshila P.S. Case No. 64 of 2023 corresponding to G.R. No. 183 of 2023.
