Considering the fact that more than 85% of work under the Tender is completed and in such an eventuality, even if the petition is allowed, the petitioner cannot be permitted to participate in the tender process or even if the tender in question is cancelled, the petitioner will not get any relief. 3. In the circumstances, the only remedy available with the petitioner is to seek damages. 4. In that view of the matter, learned counsel for the petitioner, Shri Omkar Deshpande, seeks permission to withdraw the present writ petition with liberty to file a suit for damages by keeping all the points open, if he so desires. 5.
