Present application under Section 528 of B.N.S.S. has been filed to quash the order dated 16.12.2024 passed by Additional Sessions Judge, Court No. 20, Agra, in S.T. No. 245 of 2009 (State vs. Maharaj Singh and others), arising out of Case Crime No. 306-A of 2005, under Sections 323, 324, 504, 506 of I.P.C., P.S. Sikandera, District Agra, whereby charge has been amended and a direction has been issued to frame charge under Section 325, 326, 307, 452 of I.P.C. After some arguments, learned counsel for the applicants does not want to press the relief of quashing the order dated 16.12.2024. Learned counsel for the applicants submits that cross-case of the incident is pending between the parties in same court. It is further submitted that prior to submitting charge sheet in the present case, applicants have been released on bail under Sections 323, 324, 504, 506 of I.P.C. Learned counsel for the applicants further prays that applicants may be released under Section 307 of I.P.C. on the basis of personal bond and sureties furnished by each applicants earlier. In view of above, Court concerned is directed to release the applicants under Section 307 of I.P.C. on the basis of personal bond and sureties furnished by each applicants earlier.
