This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 307 and 353 of the Indian Penal Code and section 27 of the Arms Act in connection with Lalmatiya PS Case No. 35 of 2023 pending in the court of learned Judicial Magistrate, 1st Class at Godda. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. There is an allegation that the Police Inspector was shot by one of the co-accused. During course of investigation it came to light that a well-planned conspiracy was hatched in which the petitioner is also a party. Based on the said conspiracy the Police Inspector who was standing as a wall between the petitioner and his illegal work, was shot by one of the accused. As there is angle of conspiracy which has been 2025:JHHC:13830 2 hatched by this petitioner and others which is apparent from the case-diary, this is not a fit case for grant of anticipatory bail to the petitioner as this case needs custodial interrogation of the petitioner. 5.
