ORDER: The Criminal Petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to relax the condition imposed on the petitioners/Accused Nos.1 and 2 by the I Additional District and Sessions Judge-Special Judge for Trial of Offences under NDPS Act, Visakhapatnam, in Crl.M.P.No.963 of 2025 in Cr.No.130 of 2025 of Pendurty Police Station, Visakhapatnam on 21.04.2025.
2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record.
3. Considering the facts and circumstances of the case, the order in Cri.M.P.No.963 of 2025, at paragraph No.9, is hereby modified. The petitioners/Accused Nos.1 and 2 are
directed to appear before the Station House Officer, Pendurty Police Station, once in two months on r the first Sunday, between 10:00 A.M. and 5:00 P.M., till the filing of the charge sheet. The remaining conditions imposed on the petitioners/Accused Nos.1 and 2 by the learned Special Judge shall be complied with without any exemption.
