Hon'ble Rohit Ranjan Agarwal,J. This writ petition has been filed with the following prayer:-
"(A) Issue a writ order or direction in the nature of mandamus commanding and directing the Learned Civil Judge Senior Division District- Sonebhadra, to decide the aforesaid Misc. Case No. 12 of 2024, Smt. Uma Kumari vs. Common Man and others (in misc. case no. 99 of 2021 Mithilsh Kumr Sharma vs. Common Man) filed under section 372 of the Succession Act pending in the aforesaid case before Learned Civil Judge Senior Division District- Sonebhadra, within a specific period as may be prescribed by this Hon'ble Court." It is contended that Letters of Administration was granted ex-parte and an application for recalling the order was moved in the year 2024, which has been registered as Misc. Case No.12 of 2024. The sole prayer made in the writ petition is for early disposal of the said case. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction upon Civil Judge Senior Division District- Sonebhadra to decide the Misc. Case No.12 of 2024, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of four months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
