1. Challenge in this petition is the order of attachment dated 05.05.2025 whereby the services of the petitioner has been attached from the
2 office of Project Work Plan Jagdalpur to the office of Forest Division Bastar place Jagdalpur. The petitioner also seeks to challenge rejection of his representation vide order dated 23.05.2025. 2. Learned counsel for the petitioner would submit that petitioner has been appointed on the post of Assistant Grade-III vide order dated 01.06.2007 and was posted at Forest Division Bastar. Vide order dated 08.03.2018 he was promoted to the post of Assistant Grade-II and posted at Indravati Tiger Reserve, Bijapur and thereafter he came to Bastar Forest Division Jagdalpur. Vide order dated 28.06.2021 passed by the respondent No.4, the work place of the petitioner is fixed at Project Plan Office at Jagdalpur and now vide order dated 05.05.2025 his services has been attached to Forest Division Bastar place Jagdalpur. He made his representation on 13.05.2025 showing his difficulty that he is having old aged mother and he has to take care of her and therefore his work place may not be changed. The said representation was rejected vide order dated 23.05.2025 and therefore the present writ petition has been filed. 3.
On the other hand, the counsel for the State opposes the submissions and submit that the work place of the petitioner has been changed from Project Plan Office Jagdalpur to Forest Division Bastar place Jagdalpur. The petitioner is temporarily attached with the Forest Division Bastar at Jagdalpur. The petitioner is not having any vested right to be posted at a particular place and it is only for the respondent authorities to place the petitioner at required place in administrative exigency. Therefore, there is no merit in the petition and the petition is liable to be dismissed. 3
4. I have heard the counsel for the parties and perused the documents annexed with the petition. 5. Admittedly, the services of the petitioner is temporarily attached from Project Plan Office Jagdalpur to Forest Division Basatar place Jagdalpur and there is no change of any division or district. Further, temporary attachment in administrative exigency does not create any reduction in rank or pay scale of the petitioner. The attachment is a temporary transfer as it involves shifting of an employee from one place to another. The petitioner is not having any vested right to be placed/posted at a particular place and it is for the employer to consider the administrative exigency under which the present order dated 05.05.2025 have been passed by the respondent No.4, in which I do not find any perversity or illegality warranting interference of this court in the present writ petition. 6.
