This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 398/2024 registered at Police Station Civil Lines, Raipur, District – Raipur (C.G.), for the offence punishable under Sections 420, 467, 468, 471/34 of the Indian Penal Code. 2. The prosecution's story, in brief, is that on 19.07.2024, the police received secret information that some individuals were involved in ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2025.06.14 12:08:41 +0530 2 preparing forged Rin Pustikas (revenue records). Acting on this information, the police conducted a raid, arrested the present applicant and co-accused Chelaram Aaswani, and seized two Rin Pustikas from their possession. Upon further investigation, the Tehsildar examined the Rin Pustikas and found them to be forged. The police subsequently filed a charge sheet against the accused persons. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He submits that nothing is seized from the present applicant and nothing forgery was performed in the records by the present applicant. He also submits that before the learned trial Court memorandum and seizure witnesses were examined by they didn’t support the case of the prosecution. He also submits that the present applicant is suffering from HIV and is highly dependent upon medicine and he is in jail since 31.08.2024, conclusion of the trial may take some time, therefore, she prays for grant of regular bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application of the applicant and submits that the applicant, along with other co-accused persons were involved in preparing forged Rin Pustikas (revenue records), therefore, he is not entitled for grant of regular bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and further the 3 fact that the applicant, along with other co-accused persons were involved in preparing forged Rin Pustikas (revenue records) and the co-accused, namely, Chelaram Aaswani, two forged Rin Pustikas were seized, therefore, I am not inclined to grant regular bail to the present applicant. 7. Accordingly, the bail application of the applicant - Ashok Yadav, involved in Crime No. 398/2024 registered at Police Station Civil Lines, Raipur, District – Raipur (C.G.), for the offence punishable under Sections 420, 467, 468, 471/34 of the Indian Penal Code, is rejected. 8. However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial as expeditiously as possible within a period of three months from the receipt of a certified copy of this order in accordance with law, if there is no legal impediment. 9.
