1. Heard.
2. This contempt petition has been filed alleging willful disobedience of order dated 24.08.2018 and subsequent directions issued from time to time in the matter of grant of various benefits to the petitioner arising from judgment passed by this Court in the case of State of Rajasthan & Anr. [2025:RJ-JP:6439-DB] (2 of 2) [CCP-47/2020] SH. Bhagwan Das Todi College (D.B. Special Appeal (Writ) No.663/2015, decided on 06.11.2015).
3. A detailed reply and additional reply both have been filed by the respondents. In the additional reply, it has been stated that the admitted amount of Rs.4,72,423/- after due deduction, as calculated by the State, has been made.
Learned counsel for the petitioner would submit that while working out arrears of 6th Pay Commission, proper pay fixation has not been made as per order dated 17.01.2008 passed by the Rajasthan Non Government Educational Institutions Tribunal, Jaipur (hereinafter referred to “the Tribunal”) in petitioner’s case Smt. Archana Khandelwal Versus Managing Committee & Others (Application No.73/2004).
4. The order which was passed by this Court earlier, of which disobedience is alleged, had not decided the claim of the petitioner on the basis of the aforesaid order. Whether pay fixation is in accordance with the order passed by the Tribunal, is outside the scope of contempt petition.
5. Therefore, the contempt petition is closed. Rule stands discharged. However, petitioner would be at liberty to challenge the pay fixation.
