Learned State counsel for the Review Petitioners submits that in terms of the judgment dated 1 Whether reporters of Local Papers may be allowed to see the judgment? - 2 - 10.11.2023, passed in CWP No.8833 of 2023, titled as Baldev Chand Bhardwaj versus State of Himachal Pradesh and the directions contained in Paras 7, 8 and 9 of the aforesaid judgment, the Review Petitioner(s)-State has already passed the order on 5.6.2024 [Taken on record], stating that the claim for revised pensionary benefits and arears shall be settled after decision of LPA filed against judgment dated 04.04.2024 in CWP No.5651 of 2023, titled Dr. Sunil Kumar Chandel and others versus State of Himachal Pradesh and others and Review Petition against the judgment dated 31.5.2023, in CWP No.2108 of 2023, titled as Bhagat Ram versus Himachal Road Transport Corporation. 3. Instant Petition was filed on 15.10.2024, which in considered view of this Court, is not maintainable when, in terms of the Judgment dated 10.11.2023 of which review has been preferred, the Review Petitioner(s)-State Authorities have already decided the claim of Writ Petitioner vide orders dated 5.6.2004, but these facts were suppressed from this Court while filing the Review Petition. 4. Be that as it may, once due to subsequent - 3 - development(s) including the passing of orders dated 5.6.2024 in compliance to Judgment dated 10.11.2023, the Learned State Counsel submits that nothing remains for determination/adjudication in instant Review Petition [Statement Taken on Record]. In backdrop of subsequent developments and as prayed for by Learned State Counsel [Para 4, supra], the instant Review Petition does not survive and the same is accordingly disposed of.
